Divorce / Legal Separation
In California, you can choose between a divorce (dissolution of marriage) and a legal separation. Although similar in many aspects, only a divorce will end your marriage, giving you the right to re-marry.
California is a no fault state but you must show irreconcilable differences in the marriage. California family law requires that you must have been a resident of the state for at least 6 months prior to seeking a divorce in California. There is no residency requirement if you are filing for legal separation.
